Background

The department grew out of 1939 legislation that created a Department of Justice, and its modern form comes from the 1971 Executive Organization Act. It houses the Attorney General's legal staff, which represents the state in court, enforces consumer-protection law and advises state agencies. It also runs the State Crime Laboratory, training and standards bodies for law enforcement, and public-safety and consumer programs. The State Bureau of Investigation was part of the department until the 2014-15 budget moved it to the Department of Public Safety, while the Crime Lab stayed with DOJ. The Crime Lab has faced past scrutiny over evidence-handling problems, which became a political issue under earlier Attorney General Roy Cooper. Jackson, a former state senator and congressman, took office in January 2025 and has said his office joined 18 lawsuits against the administration in 2025, a more selective count than the 60-plus joined by some other Democratic attorneys general. In 2026 his office joined multistate suits over a March 31 executive order on mail-in voting and over new tariffs, and sued over Postal Service control of ballots. Republicans in the legislature have criticized his litigation and threatened to shrink the office's powers. As an agency communicating on behalf of an elected partisan official, its public messaging should be read as official and advocacy-oriented rather than independent journalism.
