Background

SELC was founded in 1986 by Rick Middleton, one of the country's early environmental lawyers, and is now the largest environmental nonprofit law firm in the Southeast, with over 250 staff and nine offices across the region. It operates as a 501(c)(3) nonprofit and focuses on Clean Air Act, Clean Water Act, and land-use litigation in Alabama, Georgia, North Carolina, South Carolina, Tennessee, and Virginia. Over the decades it grew from a small regional firm into a major litigation force, with revenue reaching over $80 million in fiscal year 2022. Its single largest historical donor, North Carolina billionaire Fred Stanback, has provided the majority of its funding since the early 2000s; critics have noted that Stanback also funds population-control advocacy, raising questions about his broader worldview, though SELC's legal work focuses on environmental protection. The organization has opposed a wide range of energy and infrastructure projects, including natural gas pipelines, highway expansions, and some nuclear energy proposals, drawing charges of bias from industry groups. In the first Trump administration (2017–2021) and again in the second term starting January 2025, SELC became an active courtroom opponent of federal rollbacks, suing over EPA grant cancellations and challenging NEPA guidance withdrawals. A notable 2026 action was a Clean Air Act citizen suit against Elon Musk's xAI data center in Memphis, alleging unpermitted emissions from gas turbines. SELC does not accept government funding and describes itself as nonpartisan, though its litigation record and donor base place it firmly within the progressive environmental movement.
